A federal lawsuit has been filed against President Donald Trump regarding a Truth Social premium service providing subscribers with accelerated access to his social media posts, which may include market-moving government policy statements.

The legal action was initiated Wednesday by Freedom of the Press Foundation and The Intercept in Manhattan’s U.S. District Court. Named defendants include Trump, Presidential Executive Assistant Natalie Harp, White House Deputy Chief of Staff Dan Scavino, and the Executive Office of the President.
Marketed as Truth API, the premium offering was introduced by Trump Media on August 1. The service enables subscribers to receive content from Trump and prominent Truth Social users before it becomes publicly visible on the platform.
Monthly subscription fees range from $60,000 to $100,000. Trump Media interim CEO Kevin McGurn revealed that the service has attracted more than ten paying customers, with high-frequency trading companies comprising the majority of subscribers.
First and Fifth Amendment Arguments
The lawsuit contends that the premium service infringes upon First Amendment protections by granting paid subscribers privileged access to presidential communications that could contain official policy announcements. The plaintiffs maintain that journalists and the general public deserve equivalent access.
Additionally, the complaint raises Fifth Amendment concerns. The legal argument suggests the government cannot monetize access to publicly available governmental information. The court has not yet issued rulings on either constitutional claim.
“Nothing could be more antithetical to the free, independent press than the president charging for early access to his public announcements,” said The Intercept Chief Legal Officer David Bralow.
Trump has utilized Truth Social as a platform to reveal trade policy decisions, international relations initiatives, cabinet appointments, and defense operations. The advance notice provided by earlier access creates significant value for financial trading operations.
The complaint also emphasizes Trump’s ownership interest in Trump Media. The Donald J. Trump Revocable Trust controls approximately 41.43% of Trump Media stock, with Trump designated as sole beneficiary. This stake has been assessed at more than $1 billion in value.
Expansion Into Prediction Markets and Cryptocurrency Strategy
Trump Media is currently exploring licensing arrangements to provide Truth API information to prediction market companies as an additional revenue source. McGurn acknowledged the company is assessing potential opportunities within the prediction market sector, though specific details about the data packages remain undisclosed.
Meanwhile, the company has retreated from previous cryptocurrency initiatives. Trump Media and Crypto.com have abandoned plans for a publicly listed CRO treasury vehicle and discontinued the exchange’s participation in the proposed Truth.Fi exchange-traded fund products.
Trump Media disclosed $360.6 million in unrealized and accounting-related losses connected to digital asset holdings during the first six months of 2026.
Digital Asset Portfolio
The company’s cryptocurrency portfolio was assessed at $597.7 million as of June 30. This includes holdings of 9,477 Bitcoin valued at $557.1 million and 756.1 million CRO tokens worth $40.6 million.
The plaintiffs are requesting judicial declaration that Truth API violates constitutional principles and seeking court-ordered equal access to official presidential communications.
